340-ton rock to begin rolling to LA for art's sake (omg!)

LOS ANGELES (AP) ? After months of preparation, the rock is ready to roll.

A 340-ton chunk of granite that acclaimed earth artist Michael Heizer selected to be the centerpiece of his latest creation is scheduled to leave a dusty rock quarry in Riverside late Tuesday night.

From there it will make a circuitous, 105-mile journey to the Los Angeles County Museum of Art's backyard, where it is to become the focal point of Heizer's "Levitated Mass."

The artist plans to have the rock placed over a 456-foot-long trench in such a way that when museum visitors walk underneath it will appear to be floating in the air above them.

But first it has to get to LA from Riverside's rural Jurupa Valley, where Heizer came across it six years ago and, as the story goes, said, "That's the one."

Museum officials say the reclusive artist, who has spent much of the past 40 years building "City," a Mount Rushmore-sized project near his home in the central Nevada desert, envisioned "Levitated Mass" even before that. But he couldn't really proceed until he found the right rock.

What he found was two stories high, teardrop-shaped and so heavy and bulky it took a specially built flatbed trailer the length of a football field to transport it.

The trailer, equipped with 44 axels, built to hold at least a million pounds and powered by 550- to 650-horsepower engines in the front and back, will be accompanied by as many as 60 people who will clear a path for the rock and make sure it doesn't smash into anything going around turns. It will travel no faster than 5 to 8 miles per hour and only late at night and in the early morning.

The trip is expected to take 11 days, with the rock scheduled to roll up to the museum's back door sometime before dawn on March 10. The curious can follow the rock's progress on Twitter or through the museum's website and blog.

"We're going to keep everybody updated as to where it's parked each day," said museum spokeswoman Miranda Carroll.

It is a journey that has been delayed repeatedly over the past six months as 22 cities, from Riverside to Long Beach, have had to agree to let it roll through their communities.

Many were wary, especially given that officials say it is likely the largest rock to be moved from Point A to Point B since the days when the ancient Egyptians were building the pyramids.

The museum finally worked out a route that went around freeway overpasses, stayed away from bridges and avoided narrow streets to enough of a degree that everybody was satisfied. The total project is costing $5 million to $10 million.

"It's funny, the Egyptians didn't have rubber wheels and diesel trucks to move things. But they also didn't have 22 cities through which they had to move their stones," museum director Michael Govan noted recently.

"And in California," he added, "everybody has a say."

When we reviewed it, we found it to be virtually indistinguishable to its larger sibling: it was 10 percent smaller and 10 percent cheaper, and that was about it. But is that the whole story? A colossal part of business school I?ve yet to cover is the travel. At least in my program, there weren?t a ton of opportunities in my first semester. We were all busy meeting hundreds of new friends, exploring our new city of Boston and trying to keep up with homework and internship searches. But now first semester is O-V-E-R! I have my bearings and some great friends; I?m signed up for super interesting classes next term ? it?s time to get on a plane!

Over January, my classmates boomeranged to different corners of the globe: meeting with entrepreneurs in Tanzania, touring Amazon?s headquarters in Seattle, exploring Fiji, and hot air ballooning over New Mexico. Let?s be clear: this travel is by no means cheap, though it is framed as an integral part of the 2-year experience. Some trips are subsidized by the school if you do a corresponding class and project, so look out for those options too. Nonetheless, if you?re considering B-school, save up for some flights or plan on allocating a good deal of your loans.

I took the chance to head to Hong Kong and China with MIT Sloan?s Luxury, Retail and Consumer Goods Club. If you?ve read any WWD in recent years, you know what a huge ? make that HUGE ? deal China is in the luxury market. I couldn?t have been more excited to go.

Over the 10-day trip, we glimpsed the country?s explosive consumer spending growth face-to-
face. Plus, we got to hear about this emerging market from top industry executives. Traveling with a business school club opens a lot of doors including access to the pros at Gucci, Louis Vuitton, Apple, Nike, as well as luxury retail consultants from Bain.

In the first leg of the trip we went to Macau, Asia?s Las Vegas, and Hong Kong. Macau is? I don?t even know the word. Absurd? I toured spectacular malls with virtual mermaids swimming on the walls and tried my luck at the slot machines. Not to brag but I won $2. Then we took a boat to Hong Kong to get our dim sum on. I visited one of Hong Kong?s famous tailor shops which I highly recommend. They make custom shirts and suits for reasonable prices?think $60 for a custom, monogrammed button-down. Hong Kong is a real gem with sweeping views and packed, city-wide escalators taking crowds up and down steep hills. I absolutely love that city. We also visited with Esquel, a firm that produces shirts for companies like J.Crew and Ralph Lauren. It was refreshing to study another angle of the retail industry, hearing how there are fewer laborers willing to work for such cheap wages and what strides these big companies are taking to become more sustainable.

Before I knew it, we were off to Shanghai. My favorite memory there was speaking with Sara Villarreal, the visionary American who opened The Villa, a darling boutique in the French Concession neighborhood. She?s a total pioneer considering the consumer culture in Shanghai still centers upon overtly branded items like LV bags or Cartier watches. In these big tier one cities, nearly everyone was a walking brand billboard (whether those products are real or fake is a separate matter). Yet, Sarah has stocked her boutique with cool, subtler brands like Altuzarra and Derek Lam. To move to China, learn Mandarin, and open your own business ? wow. She?s amazing. Also, for any Mandarin speakers interested in luxury, there are tons of jobs over in Asia. Email the HR department of your favorite brand and see if they have openings (?they will)!

Now I?m back in Boston, recovering from a dumpling food coma and gearing up for second semester. I?m taking courses in marketing and leadership and finance (yawn?but important!). My internship search begins this semester too, so I?ll be busy editing my resume and answering questions like ?What?s my biggest weakness?? I have no weakness, people! Eye roll. Happily, I?ve got a little more travel penciled in too with an entrepreneurship trek to Silicon Valley and a fun Spring Break week in Israel. The No. 21 Sun Devils will travel to Malibu, Calif. to take on both Boise State and Pepperdine this weekend. The Sun Devils are coming into this weekend 5-1, and off a big win against Northern Arizona University.

TEMPE, Ariz. -

The No. 21 Arizona State Sun Devils women's tennis team will take to the road for the first time of the 2012 regular season and travel to southern California for weekend competition.

ASU will face Boise State on Saturday afternoon, and Pepperdine on Sunday afternoon. Both games will be played in Malibu, Calif. at 12 p.m. PT, 1 p.m. MT. The Sun Devils come into the game after winning big against Northern Arizona University 7-0 at the Whiteman Tennis Center last weekend in Tempe, Ariz.

"We don't know that much about Boise State. They play Pepperdine on Friday so we will be able to get there and watch a little bit of that," ASU head coach Sheila McInerney said.

The unranked Boise State Broncos, who enter into this weekend standing at 5-1, are fresh off two recent wins against Eastern Washington and Idaho. Boise State is led by Junior Marlena Pietzuch who just recently made her debut at the No. 1 spot.

Pepperdine is a little bit more familiar for the Sun Devils however. "We know Pepperdine is a very good program, they've been a good program for over 30 years," said McInerney. We know a lot of the kids on the team, so it's going to be a dog fight."

Pepperdine also has an extra variable thrown into their home court advantage mix -- the courts are at elevations fairly close to sea level. An altitude that is completely different from that of Tempe.

"It's not that big of a deal, but here (Tempe) the ball travels a little bit quicker. So the ball is not going to be traveling as quickly outdoors in California. The points are a little bit longer, and it's nothing major but you are going to play longer points that's for sure," said McInerney.

Last week against NAU, all six Sun Devil singles matches were won in two sets, including three sets that were won outright 6-0. The last time sophomore Sun Devil Jacqueline Cako went three sets deep in the No. 1 spot was against San Diego on February 5th, with ASU coming out as the victors 4-3.

Back to back play this weekend for Arizona State will help throw the team back into the loop they need to be in for conference play. ASU will play three double match weekends in the next 30 days.

"Our schedule was just a little bit weird this year because we didn't qualify for the indoor. We didn't have that many matches in a long period of time. So I think it's good for us to get back at it and have two matches so we are used to Pac-12 competition, (playing on) Friday and Saturday," said McInerney.

This is the first time the Devils have been on the road since they traveled to Las Vegas to compete in the Freeman Memorial Tournament in mid January.

"We just need to get back competing on a regular basis and having two matches, and sort of see where the girls are," said McInerney. "I think the kids are excited about it. We've been home and we haven't played at all on the road except for Vegas, which was an individual tournament."

web.tech.law - Legal Notes - Is Pinterest a den of copyright thieves?

Background

A debate whether Pinterest is flouting copyright laws by allowing its users to post, or "pin", images and videos to the site is raging online. If you haven't heard of Pinterest, it is one of the hottest new social networks that encourages users to share stuff they find on the Web. Pinterest's focus is on images and videos and the service gives users ways to republish images on the site and categorise them in "Boards". I found a great introduction video which explains the site with a series of demonstrations:

The site is enjoying tremendous uptake and once you start using it you can understand why. It enables people to create collections of ideas for their homes, brides use it to source inspiration for their weddings and share them with friends and so on. It is a truly social service but it relies on its users republishing 3rd party content to the site so questions about the copyright implications are understandable. One group of content owners who are particularly perturbed about Pinterest are photographers whose works are being published and shared on the site. Mike Masnick over at Techdirt believes this is not what photographers should concern themselves with and points to Trey Ratcliffe's post (read this post for an expanded discussion about this) about the benefits of having his photographs "pirated" as support for his position that Pinterest's benefits far outweigh any potential harm photographers may suffer by having their works pinned on the site:

Either way, his point is a strong one, and it's really no different than what many people have made to reactionary folks in other parts of the content industry. You can spend all your time trying to kill innovation or stop people from doing what they want to do... or you can bask in the wonderment that people want to do stuff, encourage them to do so, and make it easier for them to help spread your works... all the while making it easy for them to support you. Ratcliff seems to be a perfect example of our discussion on the benefits of being open, human and awesome.

Exclusive rights

Regardless of the benefits of sharing more openly or even tolerating copyright infringement, content creators are entitled to protect their rights so the question remains what those rights are and whether Pinterest is either directly infringing copyright or is facilitating copyright infringement by its users? I'll explore these questions in the context of South African copyright law which is largely governed by the Copyright Act, No. 98 of 1978.

Images and videos are categorised as "artistic works" and "cinematograph films", respectively. Provided this content is original and reduced to a material form, it is generally protected by copyright. This means that the content's copyright owner has a number of exclusive rights in and to that content ?

Nature of copyright in artistic works.

7. Copyright in an artistic work vests the exclusive right to do or to authorize the doing of any of the following acts in the Republic:

(a) ? Reproducing the work in any manner or form;
(b) ? publishing the work if it was hitherto unpublished;
(c) ? including the work in a cinematograph film or a television broadcast;
(d) ? causing a television or other programme, which includes the work, to be transmitted in a diffusion service, unless such service transmits a lawful television broadcast, including the work, and is operated by the original broadcaster;
(e) ? making an adaptation of the work;
(f) ? doing, in relation to an adaptation of the work, any of the acts specified in relation to the work in paragraphs (a) to (d) inclusive.

Nature of copyright in cinematograph films.

8. (1) Copyright in a cinematograph film vests the exclusive right to do or to authorize the doing of any of the following acts in the Republic:

(a) ? Reproducing the film in any manner or form, including making a still photograph therefrom;
(b) ? causing the film, in so far as it consists of images, to be seen in public, or, in so far as it consists of sounds, to be heard in public;
(c) ? broadcasting the film;
(d) ? causing the film to be transmitted in a diffusion service, unless such service transmits a lawful television broadcast, including the film, and is operated by the original broadcaster;
(e) ? making an adaptation of the film;
(f) ? doing, in relation to an adaptation of the film, any of the acts specified in relation to the film in paragraphs (a) to (d) inclusive;
(g) ? letting, or offering or exposing for hire by way of trade, directly or indirectly, a copy of the film.

Barring exceptions to copyright infringement (more about that below) and a license from the content owner granting permission to exercise these rights (more on this below, too), any exercise of these rights would likely be copyright infringement. Section 23(1) deals with this specifically and states the following ?

Copyright shall be infringed by any person, not being the owner of the copyright, who, without the licence of such owner, does or causes any other person to do, in the Republic, any act which the owner has the exclusive right to do or to authorize.

Copyright infringement exceptions

At this point the law becomes a little tricky. The Copyright Act recognises a series of exceptions to copyright infringement. This means there are uses of copyright protected content which, but for these exceptions, would be infringing uses. I won't republish the sections of the Act for the sake of some semblance of brevity but below are the principles which come out of the Act (this is not a complete treatment of these exceptions):

  • In respect of photographs ?
    • personal or private use does not infringe copyright;
    • using the photographs for the purpose of reviewing or criticising them is similarly not infringing; and
    • "using such work, to the extent justified by the purpose, by way of illustration in any publication, broadcast or sound or visual record for teaching [is similarly not infringing]: Provided that such use shall be compatible with fair practice and that the source shall be mentioned, as well as the name of the author if it appears on the work".
  • In respect of videos ?
    • "using such work, to the extent justified by the purpose, by way of illustration in any publication, broadcast or sound or visual record for teaching [is similarly not infringing]: Provided that such use shall be compatible with fair practice and that the source shall be mentioned, as well as the name of the author if it appears on the work".

Unlike artistic works, cinematograph films don't carry the same exceptions that permit use for "personal or private use". In the United States there is a broad exception called "fair use". We don't have fair use in our law but we do have "fair dealing". That said, "fair dealing" is pretty much limited to literary and musical works (think print publications and sheet music).

Back to Pinterest

So what does this mean so far? Well, before you even look at Pinterest's terms of use, you know that you can probably copy photos and publish them to Pinterest under the "personal or private use" exception for artistic works but the same doesn't apply to videos. If you had permissive licenses to republish those photos and videos on Pinterest from the content creators that would resolve your dilemma but that would depend very much on where you get the photos and videos from (there is a wealth of content on the Web released under flexible licenses like Creative Commons but this has to be specified - your default is always that the copyright owner reserves all rights and that means you don't have any).

Pinterest's terms of service contain content licensing provisions. These provisions comprise the broad license users grant to Pinterest and licenses Pinterest grants to its users. The purpose of these licenses is to ensure that the site can continue to operate but the challenge is that the licenses are not always in line with the rights users have to use the content on the site. Here are the relevant provisions:

In many instances it may be legally impossible for users to grant the license Pinterest takes from its users and for Pinterest to re-license that content back to users. Even where a photograph or video is made available under a permissive Creative Commons license, Pinterest's license terms are at odds with those liberal licenses. What this means is that, in the absence of legally competent permissions, using the content on Pinterest could infringe copyright. This would seem to be the case with video content and with Pinterest's use of photographs published to the site which are not licensed for that purpose. It's important to parse the distinction between the 9th Circuit striking down the unconstitutionality of overturning existing state law and them saying that opposing gay marriage is in itself unconstitutional (which they did not).

Still the 9th Circuit Court's ruling for not the first time revealed the pettiness and lawlessness behind the homophobic mindset that created Prop H8 and has kept this useless referendum on the books for over three years. Said Judge Stephen Reinhardt in his majority opinion,

Proposition 8 serves no purpose, and has no effect, other than to lessen the status and human dignity of gays and lesbians in California, and to officially reclassify their relationships and families as inferior to those of opposite-sex couples.

For now, I'll gloss over his failure to include us bisexuals in his ruling and just cut to the chase: That it's simply wrong to impose your notions of morality at the expense of the dignity of your fellow human beings.

As I said last night in my jeremiad to GOProud, the hateful organization that discriminates against liberals as everyone but liberals discriminates against them, the only thing distinguishing the LGBT community from everyone else is with whom we choose to sleep. And with whom we fall in love. Falling in love, as virtually any human being will tell you, is as involuntary as our sexual identities.

It's the love part that freaks out right wingers and homophobes so much they cannot even bring themselves to address it. This is why they confine their arguments to gay sex, something guaranteed to give their fellow homophobes the dry heaves. They faithfully trot out Leviticus, a book in the Bible that was plainly written by deeply disturbed people, as if it's the law we ought to be observing and enforcing including the capital punishment part.

It's the narrowing of their argument to anal sex, swallowing semen, one woman going down on another woman and AIDS that produces a visceral reaction in others who are simply incapable of believing that sexual orientation is something you're born with. When the Michigan Senate voted on an anti-bullying bill, House Republicans had already succeeded in inserting an amendment that neatly defanged the legislation and even subverted its entire reason for being. Michigan Republicans made it legal for one student to bully, beat and even kill a gay, lesbian or bisexual student as long as they whip out the Religion/Morality card.

Essentially, it turned Matt's Safe School Law into a 007 license for homophobes to beat gay students with absolute impunity. Even more despicably, this was hailed as a "compromise" with Republicans, despite it offering no real protections for LBGT youth who since time immemorial have been specially singled out for persecution.

This genocidal movement against LGBT youth is multi-faceted. Right wingers like Tony Perkins of the Family Research Council screamed until they were blue in the face over President Obama making Kevin Jennings the head of the Office of Safe and Drug-Free Schools. Jennings achieved notoriety in right wing circles by founding the Gay, Lesbian and Straight Education Network, which caters to straight students as well as LGBT youth. Mr. Jennings' responsibilities as President Obama's Safe Schools Czar also includes curbing drug abuse.

If they're willing to disrespect our nation's LGBT youth, then no one with an ounce of compassion and grey matter should feel beholden to respect their homophobia whether or not it's clutching a cross. The First Amendment curtails the government's attempts to establish a national religion and mandates that it respect all faiths. It does not obligate individuals to do the same.

I do not respect a religion that is not all-inclusive and seeks to destroy a portion of humankind that has been around since the earliest days of prehistory and will be around as long as our species endures. And while my passion for certain issues waxes and wanes, what will never diminish and what will the last thing for which I stop fighting, is gay rights for my people.

And if you evangelical nut jobs out there want to scream discrimination, I have but two words for you: "How does it feel?"

Seven days out, slightly more patients getting antibiotics reported improvement, but this edge disappeared by day 10 when about four-fifths of each group reported ?significant improvement? in their sinus infections, says study coauthor Jane Garbutt, a physician and researcher at Washington University.

James Gill, a practicing physician who also heads Delaware Valley Outcomes Research in Newark, Del., says the medical community has tried to slow the prescribing of antibiotics for sinus infections for years. ?But I don?t think practice patterns have changed much,? he says. Doctors are under pressure from patients to do something, and telling them their symptoms are likely to resolve in a week or so rarely satisfies them, Gill says.

A big part of the problem is the sinuses? inaccessibility, Hughes says. (AP) ? Greece faces further hurdles and delays before it can receive a second, euro130 billion ($171 billion) bailout in spite of its lawmakers voting through more austerity measures in the face of violent protests.

The European Union's Economic Affairs Commissioner Olli Rehn on Monday called the Greek parliament's approval of a further round of budget cuts a "crucial step forward," but Germany insisted it would still take some time before the second bailout is delivered.

Germany, which as Europe's biggest economy pays the largest part in bailout deals, said it wouldn't give its final approval for the new aid payments until early March ? after it becomes clear how many banks and investment funds are willing to take losses on their Greek bonds and the parliament in Berlin votes on the new measures.

Pushing the new bailout back for several weeks underlines the amount of distrust that has built up against Greece over the past two years, when many promised cuts and reforms were passed in its Parliament but never actually implemented.

But it also means that Greece, its citizens, and the rest of the world economy won't know for several weeks whether the country can avoid a potentially disastrous default. A bankruptcy could force Greece out of Europe's euro currency union, drag down other troubled eurozone countries and further roil global markets.

"Germany is trying to get the best deal it can by putting pressure on Greece now," said Ben May, European economist at Capital Economics in London. The idea is to "give Greece a bit more of an incentive over the next few weeks to speed things up and get things moving."

But delaying the final approval of the bailout is not without risk. Uncertainty over the new rescue money could dissuade some of Greece's private investors from participating in a separate bond swap deal, May warned. A hitch in getting the bailout package through national parliaments in the eurozone could also push Greece perilously close to missing a euro14.5 billion bond redemption on March 20, he added.

Greece's political leaders scrambled over the weekend to get new far-reaching austerity measures through Parliament ahead of a meeting of the finance ministers from the 17 euro countries on Wednesday. The drastic cuts debated on Sunday included axing one in five civil service jobs over the next three years and slashing the minimum wage by more than a fifth.

As Greek lawmakers voted on the new cuts, the streets of Athens and other cities were rocked by violent protests. In Athens, at least 45 buildings were burned while dozens of stores and cafes were smashed and looted. Police arrested at least 74 people and detained a further 92, while in several cases they had to escort fire crews to burning buildings after protesters prevented access.

However, the Greek Parliament's vote hasn't brought an end to the uncertainty. Apart from some technical decisions, several key issues remain:

?It is unclear whether the new spending cuts, the debt relief deal and the new bailout will be enough to bring Greece's debt load down to 120 percent of economic output by 2020 ? the maximum its international creditors perceive as sustainable.

Several weeks ago, the EU estimated that there was still a financing gap of around euro15 billion ($20 billion) and an EU official on Monday could not say whether the gap has since decreased. There is hope that the European Central Bank, which also holds a significant amount of Greek debt can help close that gap by forgoing profits on those bonds.

?Greece's debt sustainability depends on whether enough private investors participate in a bond swap designed to slice some euro100 billion ($132 billion) off Greece's euro350 billion ($464 billion) debt pile. Athens wants banks and other investment funds to exchange their old Greek bonds for new ones with half the face value, lower interest rates and longer repayment deadlines. But the deal will only work if almost all private bond holders take part. If not enough of them sign up, Greece could still pass new legislation that could force holdouts to participate.

?Athens still needs to spell out how exactly it plans to cut an extra euro325 million in spending this year. The sum was included in the austerity package that passed through parliament, but Greece hasn't said where the money will come from. An EU official said Monday that much of the euro325 million could come from further cuts to Greece's defense budget.

?The other 16 countries that use the euro are still waiting for the leaders of Greece's two main political parties to commit in writing to implementing the new austerity measures even after elections expected for April. Both the Socialists and the center-right New Democracy party backed the package in the parliamentary vote, but New Democracy leader Antonis Samaras has said that he disagrees with some of the measures.

?National parliaments in Germany, Finland and the Netherlands will have to vote on the second bailout package. Since those countries are traditionally most critical of bailouts, the votes are unlikely to happen before there is clarity on whether the bailout deal will actually make Greece's debt sustainable again. Germany said its parliament will vote on Feb. 27.

Germany's insistence on taking more time to decide whether it is willing to send more bailout money to Greece means the final decision on the rescue loans will have to be split from the bond swap deal.

The swap offer for private investors has to be launched this week so that it can be completed ahead of March 20, when Greece has to redeem some euro14.5 billion in bonds.

The finance ministers from the other 16 countries that use the euro as their currency could give Greece the green light to make the swap offer to investors at their meeting Wednesday, which would give investors several weeks to decide whether to participate.

However, the finance ministers "will have to provide the private sector with some assurances on the second bailout in order to for them (the private bondholders) to look at the deal and make a real judgment," said Capital Economics' May.

"Everything takes place or nothing takes place and that by definition makes it a more complicated and time consuming process," May warned. "Assuming a deal is put in place, it's likely to come right down to the wire."
